TERMS OF SERVICE AND DISCLAIMERS

I understand and agree that West Virginia Housing Development Fund (“the WVHDF”) is not a law firm, mortgage broker, or an attorney and may not perform services performed by an attorney or broker. Rather, I am representing myself in this legal matter. No attorney-client relationship or privilege is created with the WVHDF. The WVHDF exists solely within the State of WV. I agree that regardless of where I reside or where my browser is physically located, my viewing and use of the WVHDF occurs solely within the State of WV, and that all content and services shall be deemed to be served from, and performed wholly within, WV, as if I had physically traveled there to obtain such service. I agree that WV law shall govern any disputes arising from my use of this website, and that the courts of the State of WV, shall have exclusive jurisdiction over any disputes.  I understand that the WVHDF's review of my answers is limited to completeness, spelling and grammar, and for internal consistency of names, addresses and the like. I will read the final document(s) before signing it and agree to be solely responsible for the final document(s). I will hold the WVHDF and its agents harmless. If there is liability found on the part of the WVHDF, under no circumstances will there be consequential or punitive damages. I have read and understand the following: My access grants me a limited license to the WVHDF’s software to create my MRAP Application Package. Abandoned applications will result in cancellation and not be considered as non-performance on behalf of the WVHDF as commitment to service this order. In exchange for full acceptance of the terms of service for the product designated as software to create my MRAP application, the WVHDF grants the customer a limited right to access the software provided. This product is limited to the use of the head of household, their property management company, landlord, and sharing will be cause for an immediate termination.  This access right will be in place for up to 270 days following the day the customer accesses any WVHDF products and or services. If the access period lapses without completion of the MRAP application, the WVHDF has no further obligation to the customer, including but not limited to providing access to the application. This section is subject to all other provisions of the terms and conditions, including but not limited to the “WARRANTY" section of the Terms of Use.

If I do not agree to all of these terms, I will immediately cease my use of this Site.
